How can I modify a child custody agreement?
In Alaska, a child custody agreement may be modified if both parties agree to the changes. In some cases, if the court finds that modifying the agreement is in the best interest of the child, it may allow the modification even if both parties do not agree. Modifications can be made by filing a motion to modify with the court. The motion should include details of why the modification is necessary, and should typically be filed by an attorney. However, in some cases, a parent may file for modification without an attorney. After filing the motion, both parties will be ordered to attend a hearing, where the court will take into account both parties’ arguments and make a decision. In order to modify a custody agreement, it must be proved to the court that there has been a substantial change in circumstances since the agreement was made. Examples of changes that could impact a custody agreement include changes in employment, relocation, the relationship between the children and their parents, or other factors. The court will consider the change in circumstances and whether it is in the best interests of the child before deciding to modify the agreement. If a modification is approved by the court, the court will order the original custody agreement to be modified accordingly. It is important to note that modifications can be made to other aspects of the agreement, including the parenting plan, child support, or the child’s residence.
