How can I modify a child custody agreement?

In New Jersey, a child custody agreement can be modified if there is a substantial change in circumstances. In order for a court to modify the agreement, the change must have occurred after the previous agreement was made. When deciding whether a change is substantial, the court will consider factors like the best interests of the child, the age of the child, and the amount of time the child spends with either parent. If the parents involved in the agreement agree to a modification, they can submit a written settlement agreement to the court. The court will then review the agreement to make sure that it is in the best interests of the child before it is approved. If the parents cannot reach an agreement or the court is not satisfied with the agreement, then a hearing must be conducted. During the hearing, both parents will present evidence regarding why a modification should take place and why it is in the best interests of the child. The court can then approve or deny the modification. If you and the other parent are in agreement, it is usually simpler and cheaper to make the change through the court. However, not all modifications require court approval. The court would have to approve a modification that would affect visitation times, but other changes such as a change in address or an adjustment to child support can take place without court approval.
