Does gender affect a custody decision?
In Missouri, gender does not play a role in the determination of custody. Though it may be hard to believe, prior to the mid-twentieth century, fathers were often given preference in custody cases, regardless of their capabilities as a parent. Today, gender is not a factor in custody cases in Missouri. The primary factor the court considers in custody decisions is what arrangement is in the best interest of the child. The court will look at a variety of factors in deciding custody, such as the age and sex of the child, the parents’ physical and mental health, and their financial status. The court will also consider the wishes of the child’s parents and the child’s relationship with each parent. The court will also consider any history of domestic violence or substance abuse by either parent. In Missouri, the court may order shared custody or sole custody. Shared custody is an arrangement where both parents share the responsibilities of raising their child. Sole custody grants one parent the primary responsibility of caring for the child. If a court orders sole custody, the other parent may still retain certain rights, such as visitation rights. It is important to remember that in Missouri, gender does not play a role in determining child custody – the court’s main concern is what arrangement serves the best interest of the child.
