What is the law regarding child relocation?

In California, the law regarding child relocation is codified in Family Code section 7501, which applies if a parent wishes to take a child to live in another state or more than 150 miles away in the same state. If a parent wishes to move out of state, they must file a Petition to Relocate with Children with the Superior Court and serve it on the other parent. The petition must include the proposed new address, reasons for the move, and proposed terms of visitation with the other parent. If the other parent does not agree to the proposed relocation, a hearing is held to determine if it is in the child’s best interest to move. The court will consider factors such as the child’s age and health, the family’s lifestyle, and the quality of education, medical care, and emotional support each parent can provide the child in either location. The court may also consider the impact the relocation will have on the relationship the child has with the non-relocating parent. If the court grants the relocation, it will also decide what visitation rights the non-relocating parent has. For example, the court may grant the non-relocating parent the right to reasonable visitation, virtual visitation, and/or visitation during holidays and school breaks. The court may also grant the non-relocating parent the right to reasonable travel expenses to visit the child in the new location.
