Who will be responsible for paying child support?
In California, both parents are responsible for financially supporting a child in a “divorce” or separation situation. If the parents have joint physical custody of the child, meaning that both parents share in the physical and legal responsibilities of the child, then both parents should contribute to the support of the child. If one parent has sole physical custody of the child, the court will usually require the other parent to pay child support to the parent with physical custody. The amount of child support is based on the income of the parents, their ability to pay, and the needs of the child. Additionally, the court may require one parent to maintain health insurance for the child, as well as pay for any extracurricular activities and educational needs. The court may also order the non-custodial parent to pay an additional amount for day care to help cover the costs of daycare for when the custodial parent works. Both parents are obligated to pay child support to ensure that their child has adequate financial support and the necessary resources to thrive. If either parent fails to pay the ordered support, they may face serious penalties, including but not limited to, wage garnishment, liens on property, and in extreme cases, possible jail time.
