What happens if I can’t afford to pay child support?
If you are unable to afford child support in the state of Florida, there is a process that can help. The Child Support Program (CSP) works with both parents to establish a court-ordered amount for the parent to pay in child support. If the parent requesting child support is receiving public assistance, the CSP will also establish and collect the support payments. If the parent paying support is unable to afford the court-ordered amount, there are options available. The CSP encourages parents to come to a mutual agreement on the amount of support, however if this fails, the parent has the right to petition the court for a modification of support payments. The court will then determine if the parent has a reasonable and justifiable cause to modify the amount such as a change in financial circumstances or income. In the event that the court orders a modification, the parent can contact the CSP. The CSP will review the court order and, if necessary, provide the necessary paperwork to have the amount reassessed. The CSP also provides financial assistance programs designed to assist parents who are unable to pay child support. These programs provide financial aid, assistance with job placement, and other resources to help the parent become financially stable so that the support payments can eventually be met.
