What rights does a stepparent have in a child custody case?

In New Mexico, stepparents do not have any inherent rights in a child custody case. However, the court may grant stepparents certain rights if it is in the best interest of the child. Generally, courts will allow stepparents to be involved in the process of making decisions about the child’s upbringing, health, welfare, and education. Stepparents may also be granted visitation rights or the right to communicate with the child if it is deemed appropriate for the child’s well-being. The visitation or communication rights of the stepparent may depend on the relationship between the stepparent and the child. If the court determines that it is in the child’s best interest, a stepparent may even be granted legal guardianship over the child. In all cases, the court will consider the best interest of the child when making a decision. That means that the court will consider the involvement of the stepparent in the child’s life, the relationship between the stepparent and the child, and other factors. Ultimately, the court will determine whether it is in the child’s best interest to grant a stepparent certain rights.
