What is the difference between joint and sole legal custody?

Joint legal custody and sole legal custody are two different types of child custody arrangements in Oregon. Joint legal custody means that both parents share the responsibility of making important decisions for the child, such as decisions regarding education, health care, religion, and other aspects of the child’s life. On the other hand, sole legal custody gives one parent the sole authority to make those same decisions for the child. Sole legal custody means that one parent has the authority to make decisions for the child without consulting the other parent. This parent has the right to provide the child with medical care, decide what schools the child attends, give consent for medical procedures, and make other decisions without consulting the other parent. The court may grant either joint legal custody or sole legal custody based on a variety of factors, such as the parents’ ability to cooperate and communicate, the parents’ ability to provide a safe and stable environment for the child, and the child’s wishes. In Oregon, the court generally prefers to award joint legal custody if both parents are able to work together amicably.
