What is the process for establishing paternity?
Establishing paternity is the process of determining legal fatherhood of a child. In North Carolina, establishing paternity is important as it establishes the parental rights and responsibilities of both the father and the mother. In North Carolina, there are several ways for establishing paternity. The easiest and least expensive way is to complete a voluntary acknowledgment of paternity. This document can be signed at the hospital during the birth of the child and be filed with the register of deeds. Another way of establishing paternity is through genetic testing. In North Carolina, genetic testing can be requested by the mother, the father, the child or the Department of Social Services. If the father refuses to take the test, a court order may be obtained to compel him to do so. Establishing paternity can also be done in court. This may be done when the father does not agree to sign the voluntary acknowledgment form or when either parent is uncertain of the paternity of the child. The court will order genetic testing and may also use other evidence to establish paternity. Regardless of the method used to establish paternity, it is important to do it as soon as possible. Establishing paternity legally gives a child access to many benefits such as health insurance, Social Security, inheritance rights, and more. In North Carolina, it is possible to modify an existing paternity order if it is determined that it is in the best interests of the child.
