What legal remedies are available in China?
In China, parties can pursue several legal remedies in business ventures. Depending on the specifics of the dispute, remedies can include arbitration, mediation, and litigation. In some cases, the parties can reach a settlement outside the court, such as through negotiation. Arbitration is an agreement in which both parties confer with an unbiased third-party arbitrator, who helps them come to a resolution. Usually, the arbitrator has expertise in the disputed subject matter and is able to make a final binding decision on the dispute. Mediation is a process in which the parties bring their dispute to a third-party mediator, who assists them in finding a fair and equitable resolution that is agreeable to both sides. Litigation is the traditional way of resolving disputes in China. A court or tribunal hears the evidence and arguments from both sides and makes a final decision on the matter. The decision is binding, and the losing party must abide by it. In the event of an appeal, the court may ask for additional evidence and testimony. In addition to the abovementioned remedies, China has several laws in place to protect business ventures. These laws include the Anti-Unfair Competition Law, the Anti-Monopoly Law, the Contract Law, and the Foreign Direct Investment Law. All of these laws establish specific standards and rules for conducting business in China. These remedies are available to businesses in Florida, as well as in other countries with similar laws in place.
