What is the process for obtaining a trademark registration in China?

Obtaining a trademark registration in China involves a few steps. First, the applicant will need to complete and submit an application to the China Trademark Office, which is part of the State Administration for Industry and Commerce. This application must include a representation of the trademark, a list of goods or services that the trademark will represent, and a power of attorney. The power of attorney should be completed with the help of a Chinese lawyer. After the application has been submitted, the China Trademark Office will review it to ensure that it meets the requirements and deserves to be registered. This can take anywhere from nine months to a year. If the application is approved, the applicant will need to pay a registration fee. Once the fee is paid, the trademark is officially registered in China. The trademark is then published in the China Trademark Gazette, and if no one objects to the registration within three months, it is considered valid. The registration is valid for ten years from the date of filing, and can be renewed for an additional ten years. In order to remain valid, it’s important for the applicant to use the trademark properly and not allow third parties to use it. The trademark can also be cancelled if the applicant fails to pay the registration fee on time, or if the trademark is not used for a period of three consecutive years.
