What legal procedures are necessary for the registration of patents in China?
The process for registering patents in China requires diligence and careful attention to legal procedures. First, before applying for a patent, you must determine if your invention is eligible for protection under Chinese law. Ineligible inventions are those that have already become known to the public and have been published in other countries, or those that are deemed scientifically or technologically impossible to implement. Second, you must file an application with the Chinese Patent Office. To file the application, you will need to provide a full description of the invention, as well as proof that the invention is new, useful, and non-obvious. You will also need to submit a statement of inventorship and any relevant supporting documents, such as drawings or photographs. Third, the Chinese Patent Office will conduct a search for identical or similar patents that have been registered and published in other countries. If the Office finds a patent that is identical or similar, the application will be rejected. If the search turns up nothing, the application will be published and examined. Fourth, a patent may be granted after the application has been reviewed and accepted. The Patent Office will issue a certificate of patent registration with details of the invention, and the rights and benefits given to the patent owner. Finally, the patent must be renewed once every ten years in order to maintain its validity. The patent owner must pay a renewal fee within six months of the anniversary date of the patent. If a renewal fee is not paid, the patent will lapse. Therefore, it is important to keep track of the expiration date and to pay the renewal fee on time.
