What is the legal process for registering a trademark in China?
In order to register a trademark in China, one has to apply to the China Trademark Office (CTMO). First, an application must be made for the trademark. This includes submitting a trademark application form, which includes a description of the goods or services for which the trademark is sought, as well as a statement that the applicant is the rightful owner of the trademark. The applicant must also offer proof that the chosen trademark has not been registered by another party, and a fee must be paid for the application. After the examination, the CTMO will issue an official filing receipt and proceed to publish the trademark in the Chinese Trademark Gazette. If there are no objections lodged within three months of the publication date, then the CTMO will approve the trademark. The applicant will then receive a notification of registration, which is valid for ten years. After the registration expires, it must be renewed in order to maintain the right to the trademark.
