How can a foreign business beneficiary assert rights to a Chinese domain name?
When a foreign business beneficiary wants to assert their rights to a Chinese domain name, they can turn to the China Business Ventures Law in West Virginia. This law provides a framework for foreigners to resolve domain name disputes with Chinese businesses. In order to assert their rights to a domain name, the foreign beneficiary must first begin the dispute resolution process set out in the law. The process begins with providing the Chinese business with written notice of the dispute, along with evidence of the beneficiary’s right to the domain name. The notice must contain the domain name in dispute, the address of the Chinese business, and contact information for the beneficiary. Once the beneficiary has sent the notice, they must then establish their legitimate interest in the domain name. This can be done by providing evidence that they have a website or business that uses the domain name in question, or that they have used the domain name for some other purpose in the past. In addition, the beneficiary must demonstrate that they registered the domain name before the Chinese business. This can be done by providing proof of their registration with a service such as GoDaddy, or other online registrar. Next, the beneficiary must notify the Chinese business of the dispute and request that the business resolve the dispute within a certain time frame, in accordance with the China Business Ventures Law. If the Chinese business does not reply to the request, the foreign beneficiary can then file for a domain name dispute resolution process, such as the one set out by the World Intellectual Property Organization. If all else fails, the beneficiary can also take their case to a Chinese court. The court will then hear each side of the dispute and decide which party has the rightful claim to the domain name. Foreign beneficiaries should be aware though, that the court may not always be able to protect their rights to the domain name. Before beginning the dispute resolution process, it is very important for the beneficiary to obtain legal counsel.
