How does Chinese law regulate the use of trademarks and copyright in China?

In China, the law regulating the use of trademarks and copyright is the Trademark Law of the People’s Republic of China. This law protects trademarks, copyrights, and other forms of intellectual property in China. It requires that individuals and companies register their trademarks in order to gain exclusive rights to their work. Without registering a trademark, a person or company isn’t able to enforce their exclusive rights to their intellectual property. Organizations or individuals claiming rights to their intellectual property must also show that their trademark or copyrighted material is unique. It must not be the same as any other trademarks that are currently registered in China. China applies a “first to file” system, meaning whoever registers their trademark first has exclusive rights to it. In general, the trademark law prohibits anyone from using a trademark that is identical or similar to an existing trademark without authorization. It also prevents another party from using a trademark that is likely to lead to customer confusion. In addition, the law prohibits anyone from copying or modifying a trademark without permission. Finally, the Chinese trademark law bans any person or company from profiting off a trademark or copyright without the owner’s permission. This includes counterfeiting, selling knock-off products, or selling items that feature a trademark or copyrighted material without the owner’s consent. Violations of the Trademark Law are subject to criminal or civil penalties.
