What are the different types of civil cases?
Civil law in Michigan encompasses a wide variety of cases. These cases can be divided into two main types: contract disputes and tort cases. Contract disputes involve disagreements between two or more parties that have entered into a contract or agreement. These cases are often heard in small claims court, which is designed to settle disputes more quickly and at a much lower cost than the traditional court system. In contract disputes, the dispute is usually over the terms or conditions of the agreement. Tort cases are civil cases relating to issues of personal responsibility and accountability, such as personal injury, negligence, and intentional wrongdoing. In tort cases, the plaintiff is seeking compensation for a physical or mental injury caused by the defendant. Generally, the plaintiff will try to prove that the defendant failed to act responsibly or acted recklessly in causing the harm to the plaintiff. Other types of civil cases include breach of fiduciary duties, in which one party is not fulfilling their obligation as a trustee to another party. Medical malpractice cases involve an alleged error on the part of a medical professional that resulted in harm to the patient. Product liability cases deal with injury or damage caused by a defective product or dangerous manufacturing conditions. In Michigan, civil cases can be heard in both federal and state courts. The court system is designed to ensure that both parties get a fair hearing. No matter what type of civil case is being heard, both parties are responsible for providing evidence to support their positions.
