What is a class action lawsuit?
A class action lawsuit is a type of civil lawsuit in which a large group of people, known as a “class,” come together to pursue a claim against another party. This type of lawsuit is particularly suitable for situations in which the class members have suffered similar losses or injuries, such as a defective product or an unlawful employment practice. The goal of a class action lawsuit is to hold the defendant liable and obtain compensation for the group of people who have been wronged. In Minnesota, class action lawsuits are governed by the Minnesota Rules of Civil Procedure. The court must find that common questions of law and fact predominate over individual and separate issues and that the class may be fairly and adequately represented by the proposed class representatives. If the court grants certification, this means the case may proceed as a class action. A successful class action lawsuit may result in a court order requiring the defendant to take certain actions and/or provide relief to the class members. This relief typically comes in the form of payment for damages, which is distributed to the class members. In some cases, the defendant may also be required to change their actions or behaviors to prevent the misconduct from happening again.
