What is a class action lawsuit?

A class action lawsuit is a legal action taken by a group of people who have been wronged in some way. It is typically used when a large number of people have similar legal claims, or when one person cannot take on a large company or organization alone. In North Dakota, a class action lawsuit is governed by Rule 23 of the North Dakota Rules of Civil Procedure. Class action lawsuits are typically initiated when a large group has been harmed in some way by the same company or organization. Common examples include when consumers have purchased defective products or have received poor services, or when a company has not followed the terms of a contract. The lawsuit is filed on behalf of the entire group, rather than each individual person filing their own claim. This helps to simplify the process and make it more efficient. In order to have a class action lawsuit certified in North Dakota, the group must satisfy a number of requirements. First, the group must have members who have “questions of law or fact in common.” These members must be numerous enough that individual cases would be too costly to pursue. Finally, the group’s claim must have a sufficient commonality among members. After the class is certified, each person who has been wronged by the company or organization is a member of the class and can receive a portion of any damages that may be awarded.
