What is a class action lawsuit?
A class action lawsuit is a form of civil law in which a group of people collectively bring a claim to court. Class action lawsuits are typically used when a large group of people have suffered similar losses due to the same cause. In South Dakota, many class action lawsuits are used in order to correct or compensate for wrongdoing by a company or manufacturer. Generally, a class action lawsuit is brought by one or more named plaintiffs who will be the representative of the class of people affected. The court will then decide whether the class of plaintiffs has indeed suffered similar injury or damages. If the court determines the class has suffered the same injury or damages, the judge will then decide whether to certify the class. When the class is certified, the lawsuit is allowed to move forward. During the course of the lawsuit, the class may be required to provide evidence of the injury or damages suffered by the members of the group. After all of the evidence is gathered, the court will then determine if the defendants are liable for the damages and the amount of compensation that should be paid to each plaintiff. In South Dakota, class action lawsuits can provide a quick and effective remedy for many people who have suffered similar injuries. They can also provide a strong incentive for companies to act responsibly and address any wrongs or violations that have occurred.
