What is the difference between equitable relief and legal relief?
Equitable relief and legal relief are two different types of relief that can be sought in civil law in Washington. Equitable relief is when a court orders a specific act to be done. This is commonly done when a legal remedy, such as monetary damages, is not available or would not adequately address the harm done. For example, if a contract has been violated, the court may order the offending party to perform their part of the contract. Legal relief is when a court orders a specific sum of money to be paid. This would typically involve one party paying another for damages, costs, or other losses that have been suffered. The court may also order the payment of attorney’s fees. Legal relief is usually the preferred method of relief because it is more concrete and can be easily enforced. The key difference between equitable relief and legal relief is that the former is directed towards an act while the latter is towards a sum of money. Depending on the circumstances and the goals of the plaintiff, either type of relief can be sought. Therefore, when deciding between the two, parties should consider which type of relief would best accommodate their needs.
