What is a motion to quash in civil law?
In civil law, a motion to quash is a request to a court to invalidate a complaint, or dismiss a case, on the basis that it does not contain enough information to establish a claim. In Vermont, a motion to quash is a request to the court to throw out (or "quash") a complaint for failure to properly state a claim, or for insufficient or improper legal grounds or facts. This type of motion is usually filed in the early stages of litigation, and must be made before the defendant files an answer to the complaint. A motion to quash can be raised on any number of grounds, including the failure of the complaint to set forth a cause of action, the failure to name a necessary party, the complaint’s insufficiency of facts, the complaint’s lack of clarity, or the impairment of the defendant’s ability to properly prepare a defense. If the motion is successful, the court may dismiss the case or require the plaintiff to amend the complaint. The court may also deny the motion, which allows the defendant to move forward with the lawsuit. In Vermont, a motion to quash may be made in accordance with court rules, and can be either oral or written. The motion must be filed with the court prior to the defendant’s filing of an answer. The motion must contain sufficient information to allow the court to make a legal determination as to whether to grant the motion. If successful, a motion to quash can provide the defendant with an early victory in the lawsuit.
