What is a class action lawsuit?
A class action lawsuit is a type of legal action brought on behalf of a group of people who have suffered similar harm or have similar claims. It is a way for a large group of people to join together and seek legal remedies in court. In Kansas, class action lawsuits are allowed in both state and federal courts, but the rules and procedures for bringing a class action lawsuit may vary between courts. If the court approves, then the lawsuit can proceed and a class is formed. The representative plaintiff and the defendant then engage in discovery and present their arguments to the court. Depending on the specifics of the case, the court may award damages, require the defendant to change its practices, or issue another form of relief. Regardless of the outcome of the lawsuit, the members of the group are bound by the ruling. This means that regardless of the outcome, the members of the group cannot pursue their own individual lawsuits and must accept the verdict of the court.
