What is a class representative?
A class representative is someone who is named in a class action lawsuit to represent the interests of all the other members in the class. This individual is chosen to be the representative of the group because they have similar legal concerns and damages as the other members of the class. In Washington, the court overseeing the case will usually appoint the class representative. The class representative is the only one to actively participate in the lawsuit. They are responsible for taking whatever legal action is necessary to advance the case and ultimately reach a successful resolution. The class representative is often the primary negotiator in any settlement that is eventually reached. The appointed class representative is also the one who ultimately makes the decision on how the settlement money will be distributed among the members of the class. The individual must use their best judgment to make sure the settlement is fair to all members of the class. It is important for the class representative to be fair, honest, and impartial when making decisions and negotiating settlements. In Washington, the class representative is also responsible for notifying all the members of the class about the developments of the lawsuit. This is usually done through direct mail or newspaper advertisements.
