What is a class action settlement?
A class action settlement is an agreement reached by the parties in a class action lawsuit. When parties in a class action reach an agreement, they usually enter into a settlement agreement that is submitted to the court for review and approval. In Alaska, class action settlements are regulated under the Alaska Rules of Civil Procedure (ARCP). A class action settlement usually involves a resolution of the disputed issues in the lawsuit. It also typically involves a payment by the defendant(s) to the plaintiff class, although this payment may be in the form of an award of services or goods instead of cash. The amount of the settlement is typically determined by the parties after negotiations. The settlement agreement also typically allocates the settlement money among the members of the class who have joined the suit, a process known as “distribution.” This means that the court will decide how the settlement money will be allocated among the members of the class who have joined the suit. This process is designed to ensure that each member of the class gets a fair share of the settlement money. Finally, the settlement agreement will also typically include provisions for non-monetary relief, such as injunctive relief. This non-monetary relief can include measures to ensure that the illegal practices that gave rise to the lawsuit do not happen again, or that similar misconduct is not repeated in the future. In summary, a class action settlement is an agreement between the parties in a class action lawsuit that resolves the disputed issues in the suit and allocates the settlement money among the members of the class who have joined the suit. It can also involve the award of non-monetary relief to ensure that similar misconduct is not repeated in the future.
