How are class action settlements distributed?

Class action settlements are distributed in a variety of ways in New York. Depending on the class suit and the specific circumstances of the case, the distribution of the funds may vary. Generally, in most class action suits, the settlement money is divided amongst members of the class according to their claims and the damages they suffered. Upon final judgment, the lead plaintiff and the court will create a claims process that will allow members of the class to submit claims for participation in the distribution of the settlement. This administrator, appointed by the court, is responsible for ensuring that funds are distributed in a fair and reasonable manner to all members of the class. The administrator is also responsible for issuing payments to the members of the class in a timely fashion.
