What is a class action waiver?
A class action waiver is a type of legal document that’s often used in court cases involving a large group of people. In Hawaii, class action waivers are typically used when a group of individuals is filing a lawsuit against one company or person. The waiver is essentially a contract between all of the plaintiffs in the class action lawsuit. In this document, the plaintiffs agree to waive their right to participate in the lawsuit as a group. Instead, they must bring their claims individually, which means that they cannot receive any benefit from the outcome of the case. This means that they won’t be able to receive any money or other compensation as part of a collective award. Class action waivers also limit the amount of damages that a plaintiff can receive. In most cases, a plaintiff can only receive a certain amount of money if they are successful in the lawsuit. This means that if the defendant has to pay out more than the agreed-upon amount, the class action lawsuit can become too costly and time consuming. Class action waivers are a way for defendants to limit their risk and limit their responsibility to the plaintiffs. By signing the waiver, the defendant is aware of their liabilities and is less likely to be taken to court. However, it also means that the plaintiffs have to accept that they are signing away their right to receive any damages as a collective.
