What is the class action fairness act?

The Class Action Fairness Act (CAFA) is a federal law enacted in 2005 that expanded the jurisdiction of federal courts in class action lawsuits. The act grants the federal courts exclusive authority to preside over class action lawsuits with more than $5 million at stake. The act also applies to class action lawsuits that involve substantial amounts of interstate commerce, including those between states and state officials. CAFA is intended to ensure that class action lawsuits are handled fairly and efficiently. In Arkansas, class action lawsuits are subject to CAFA and are required to be heard in federal courts. This means that plaintiffs and defendants in a class action lawsuit must abide by the rules and procedures established by federal law. The most important purpose of CAFA is to make sure that class-action lawsuits are handled fairly and that class-action settlements are equitable. Under CAFA, class action defendants can only be found liable if all of the members of the class are represented and all of the claims are valid according to the law. This means that the class action defendant must not only be proven guilty of a violation but must also be determined to have caused harm to all of the members of the class. Class action lawsuits can be complex and time-consuming. CAFA is designed to make sure that class action lawsuits are handled efficiently and fairly. By giving federal courts exclusive jurisdiction over certain class action lawsuits, CAFA helps ensure that plaintiffs and defendants get the most out of the process.
