What is the difference between a class action arbitration and a class action lawsuit?
Class action lawsuits and class action arbitrations are two different types of proceedings used in Florida to resolve a dispute involving multiple parties. In a class action lawsuit, all parties are represented in one court case and the court decides the outcome. In a class action arbitration, on the other hand, an arbiter outside of the court system is used to hear the dispute and come to a decision. A class action lawsuit typically involves a group of people suing or being sued by the same person or organization. The class action lawsuit is filed in a court of law and the judge oversees the case. The judge reviews all the evidence presented by both sides and makes a decision on the case. In a class action lawsuit, the individuals involved can present evidence, cross-examine witnesses, call their own witnesses, and present arguments as to why they are entitled to damages. Class action arbitrations, however, involve an arbiter, a person or board who acts as a third party to the dispute. The arbiter hears the dispute and evaluates the arguments and evidence presented by each side. The arbiter then makes a decision based on his or her evaluation. The decision is binding and cannot be appealed. In a class action arbitration, the individuals involved can still present evidence, cross-examine witnesses, and call their own witnesses, but they do not have the right to make legal arguments as in a class action lawsuit. The major difference between a class action lawsuit and a class action arbitration is the decision-making process. A class action lawsuit is decided by a judge in a court of law, while in a class action arbitration, the decision is made by an arbiter outside of the court system.
