What is the difference between a direct action lawsuit and a class action lawsuit?
A direct action lawsuit is when a single plaintiff sues a defendant for damages or some other form of relief. This type of lawsuit is based on a single individual’s damages or injury and is typically intended to provide compensation to a particular plaintiff. In contrast, a class action lawsuit is when more than one individual can join forces and sue one particular defendant. These lawsuits often involve groups of people who have suffered similar harms and are seeking gross, or overall, damages or some other form of relief. A class action lawsuit can be initiated by an individual, but it is typically initiated by a group of individuals who share a common problem but have not necessarily suffered identical damages. In Washington, class action lawsuits may be brought when the underlying facts or circumstances are substantially similar and there are at least two plaintiffs who are suing the same defendant. Class action lawsuits are important tools in achieving a larger social goal of justice and fairness. They provide an avenue for individuals to hold corporations and other entities accountable for systemic harm done to large groups of people. Furthermore, by joining together, individuals can often reduce their individual costs of pursuing justice. The results of class action lawsuits can often result in legislative or regulatory change, as well as providing compensation and relief for those harmed.
