What is the difference between a settlement class and a damages class?
A settlement class and a damages class are two different types of class actions in Idaho law. A settlement class is an agreement between the plaintiff and the defendant to resolve a dispute or a set of disputes without a full trial. This is often done to save time, money, and avoid a lengthy legal process. The settlement usually involves the defendant paying a certain amount of money or providing other forms of compensation to the plaintiff and all members of the settlement class. A damages class action, on the other hand, is a type of lawsuit in which a representative plaintiff or plaintiffs bring a claim before a court on behalf of a group of people (known as the “class“) who have suffered the same type of harm. In a damages class action, the court decides the facts of the case and, if necessary, assigns a damages award to the class. The damages award is often divided among all members of the damages class according to the degree of harm they suffered. The main difference between a settlement class and a damages class is that a settlement class requires an agreement between the plaintiff and the defendant, while a damages class requires a court ruling.
