How much notice do class members receive before a class action settlement?

In California, class members must be given notice of a proposed class action settlement no less than twenty business days before it is filed with the court for approval. Notice must include key settlement terms, such as a summary of the class action lawsuit, a description of the proposed settlement, the amount each class member will receive (if applicable), and instructions for opting out of the settlement or objecting to it. The notice must also contain instructions for class members to obtain additional information about the proposed settlement, including any material the court will consider in making its decision. It is the responsibility of the parties to the class action to provide class members with notice in the most efficient and cost-effective manner possible. For example, a notice may be sent by mail or email, or it may be available to class members on a website or public bulletin board. Notice may also be published in print or broadcast media. Regardless of the means of delivery, the proposed settlement must be clearly and accurately described so that class members can make a meaningful decision about whether to accept or reject the settlement or take any other action available to them.
