What is the difference between a class action and a collective action?
Class action and collective action are two different types of civil suits that are filed against companies or individuals in order to address an issue that affects a group of people. In either case, one person files the suit on behalf of the group of people they are representing. A class action is typically filed in state court and is usually aimed at getting compensation for a large group of people who have been affected by the same problem. Typically, class actions are used when a number of people have similar claims against a company. The end goal of a class action is to get relief and reparation for the group of people that have been affected. A collective action, on the other hand, is typically filed in federal court and is used to address issues that affect a large number of people, such as wage and labor disputes, discrimination, and other civil rights related disputes. Collective actions are initiated by a group of people, as opposed to one person, and are aimed at seeking relief for a group of people, such as back pay, lost wages, or other compensation. Both class action and collective actions are important ways for people to get justice and recover compensation for damages. In the state of West Virginia, both of these types of civil suits are recognized and available to individuals or groups that have experienced harm at the hands of another party.
