What are the legal requirements for class action notice?
In Alaska, class action lawsuits allow a number of people to bring a single claim or action to court. In order to ensure that all potential class members are informed of the action, class action notice is necessary. Legal requirements for class action notice in Alaska fall under Alaska Rule of Civil Procedure 23. Rule 23 requires that the court approve a “notice plan” which provides information to all members of the class about the action. This plan must include the title of the lawsuit, notice of the claims asserted, a summary of the process for resolving the action, instructions on how to object to the class or to individual claims, a statement of the right of a class member to opt-out of the class and how to do so, a method for class members to claimant any damages from the lawsuit, and information on how to contact the attorney representing the class. The notice plan must also be approved by the court and must be sent to all class members individually. The notice must be in an easy to understand format, sent either by regular mail or by email, and must be in a language that all class members understand. The court may also require additional notice, including publication in newspapers, radio, or television. Additionally, notice to any potential class members outside of Alaska must also be sent. Overall, the court has the authority to determine the form and manner of notice. It is important that all class members are properly notified of the action, so that they can choose to participate or opt-out if they so choose.
