What is the difference between class action and individual representation?

Class action and individual representation are two different models for handling legal claims. Class action is when a single plaintiff or group of plaintiffs file a complaint against the same defendant or group of defendants for an act or actions that affects a large number of people. Each class member is represented by the same attorneys and must prove the same legal claims in order to be successful in their case. The benefit of a class action is that it allows multiple plaintiffs to seek compensation for the same violation or issue without each plaintiff having to go through the same lengthy litigation process. Individual representation, on the other hand, is when one plaintiff brings a complaint against a single defendant or a group of defendants. The plaintiff must prove their legal claim, including the facts surrounding the case and the legal standard which applies. While this model of legal representation is less time-consuming, it may also be more costly and difficult to win due to the fact that only one plaintiff is involved. In West Virginia, for instance, class action lawsuits may be filed to address cases such as consumer fraud, wrongful death, and medical malpractice. However, individual representation may be used to file claims related to personal injury, property damage, and breach of contract.
