What is the difference between class action and joinder?

Class actions and joinders are two ways of suing someone for damages in New York. Class actions are when multiple individuals or entities sue a defendant for similar grievances, all in one lawsuit. All of the participants in a class action share any reward or settlement money gained from the lawsuit. Joinder is when multiple individuals or entities join forces in one lawsuit, but each plaintiff has different grievances against the defendant and is collecting damages separately from the other plaintiffs. In New York, there are specific criteria to consider when deciding which course of action to take. These criteria include whether a single injury or multiple injuries occurred; the size of the expected damages; and the complexity or simplicity of the case. Class actions are often used when there are numerous plaintiffs, as it simplifies the legal process. It also allows for the class to share settlement money, which can benefit individuals who have suffered smaller damages. Joinders are used when there are a few plaintiffs with different grievances against the defendant, such as when toxic chemicals have been released in different areas or when different parts of a company have been affected by fraudulent activity. Class actions and joinders both serve their purpose, but it’s important to understand their differences in order to decide which one is right for your situation.
