What is the effect of class action damages on individual class members?
Class action lawsuits in Kansas allow a group of individuals, who have suffered similar damages due to the same conduct of another party, to join together in order to pursue a claim. This type of lawsuit is especially beneficial in situations where the damages suffered by each individual may not be significant enough to warrant the filing of an individual lawsuit. When a group of individuals prevail in a class action lawsuit, the damages awarded by the court are shared among all of the class members. The amount of money each class member receives is determined by the court. In most cases, the damages are shared among each class member in the form of a settlement, which is typically a lump sum payment. In addition to the monetary damages, the court may also award injunctive relief or “equitable relief”, which seeks to prevent certain actions from occurring in the future. This type of relief is beneficial to the class of individuals as a whole, as it helps prevent the same action from occurring again in the future. The effect of class action damages on individual class members is that they may receive a small portion of the total damages awarded by the court. While these damages are important in a sense that they can help compensate the individuals for their losses, they are generally not enough to make a significant difference in the lives of the class members. In addition, the injunctive relief, which is beneficial to the entire class, may not directly help individual class members.
