What is a graduated class action settlement?
A graduated class action settlement is a type of class action lawsuit settlement used in Hawaii and elsewhere in the United States. This type of settlement is intended to provide more fair and equitable compensation for the individuals involved than a traditional class action lawsuit. In a graduated class action settlement, the settlement is divided into multiple tiers or “classes” of recovery. Each class is based on the level of harm or injury caused by the defendant. For example, a settlement may include a first class of victims who have suffered the most serious harms, such as medical bills or loss of wages, and a second tier of recovery for those who have suffered less serious damages. The amount of money each tier of settlement will receive is determined by the court and the attorneys involved in the case and is typically based on the extent of the damage caused by the defendant. The higher the tier, the more money the plaintiffs are likely to recover. Graduated class action settlements are beneficial to both plaintiffs and defendants. It ensures that victims of the same incident are compensated based on the extent of their losses. At the same time, defendants can avoid the cost of a full trial, as well as the possibility of a large jury award.
