What is the difference between a class action lawsuit and a citizens’ suit?
Class action lawsuits and citizens’ suits are both types of legal proceedings, but they each have different goals and requirements. A class action lawsuit occurs when multiple people have been wronged in the same way. One or a few individuals will act as the class representative and sue the offending person or organization on behalf of the entire group. The court must certify the class action before the lawsuit can move forward. Class action lawsuits are a type of civil lawsuit, and the purpose is to seek compensation for the wronged individuals. On the other hand, a citizens’ suit is a type of lawsuit brought by a private citizen or group of citizens against the government or a private entity, alleging that their rights have been violated. Citizens’ suits are most commonly associated with environmental protection laws, but this type of lawsuit may also be filed for other violations such as failing to follow a specific statute or regulation. The goal of a citizens’ suit is usually to enforce a certain law or regulation, although in some cases an individual may also be able to receive monetary compensation. Unlike a class action lawsuit, a citizens’ suit requires no certification from a court before proceeding and may be brought by an individual or group at any time.
