What is a motion for reconsideration in civil litigation?

A motion for reconsideration is a legal action taken in civil litigation in Texas. It is a formal request for the court to change its ruling on a decision. It is generally used when a party involved in civil litigation disagrees with the outcome of the court’s ruling and believes the judge made a mistake in the ruling. To be successful in filing a motion for reconsideration, the person filing the motion must provide "Newly Discovered Evidence" that was not available at the time of the ruling or "Evidence of a Manifest Error of Law or Fact" that was overlooked or misapplied by the court. The person must also provide a written argument to support the motion. A motion for reconsideration must be filed within 10 days from the date the court issued its final ruling. It is then reviewed by the court and the judge will either grant or deny the motion. If the motion is granted, the court will either hear new evidence or give the case further consideration. The court may also refer the case to mediation, or order a new trial. It is important to recognize that the court typically only grants motions for reconsideration in rare cases. Because of the strict time limits, it is also important to act quickly if you believe the court made a mistake in its ruling.
