What are the civil litigation requirements for service of process?

In Oregon, the rules of civil procedure, Rule 4, states the requirements for service of process. Service of process is the formal delivery of legal documents to a person or entity to let them know that a legal action has been started against them and that they are being sued. The process server is someone that is authorized to deliver the legal documents. The process server must be an adult over the age of 18 and must be able to swear under oath that they personally served the documents to the defendant. The documents can either be delivered to an adult resident of the defendant’s household, another person or entity authorized by law, or be left with the defendant. The documents must also be served to the defendant’s attorney or other designated representative if the defendant is represented in court. If a defendant refuses to accept service, then the process server must provide the required documents by mail. If the defendant is not served within 30 days of filing, the court may dismiss the case. It is essential to ensure that all rules are followed when it comes to service of process and that the documents are properly served. If not, the court may also order a new trial or award attorney’s fees.
