In Tennessee, the laws governing personal privacy and data protection are mainly based on the federal regulations laid out by the federal government, as well as the Tennessee Uniform Trade Secrets Protection Act. As per the federal regulations, any organization, business, or individual, must not collect any sensitive personal data from another individual or business without the individual or business’s explicit consent. The Tennessee Uniform Trade Secrets Protection Act (TUTSPA) also provides protection from the misappropriation of confidential business information. Additionally, the TUTSPA prohibits any person from unlawfully acquiring a trade secret from someone who has a duty to keep it confidential. The state of Tennessee also has certain laws in place to protect the personal information of children, such as the Tennessee Student Data Privacy Act. Under this law, any school in the state must protect the personal information of students by using encryption and other security measures. Additionally, any school in Tennessee must notify parents when any of their student’s personal information is collected. Finally, individuals in Tennessee are also protected by the Tennessee Consumer Protection Act, which prohibits any companies from engaging in deceptive or unconscionable acts in order to obtain personal information from an individual. Under this law, any company or individual that engages in such practices can be held liable for any damages caused to an individual.
