What are the laws concerning encryption and digital signatures?

In the state of Florida, computer laws concerning encryption and digital signatures are governed by the Electronic Signatures in Global and National Commerce (ESIGN) Act. This was a federal law passed in 2000 and it is designed to protect citizens by providing legal recognition of electronic records, digital signatures, and contracts. Encryption is the process of encoding information using a complex algorithm, making it impossible to read without a “key” that is used to decode it. Digital signatures are used to authenticate a user’s identity when signing documents electronically. The ESIGN Act protects consumers by recognizing the reliability of digital signatures and other electronic records. Under this law, digital documents and signatures are given the same legal force as traditionally-signed documents. It also allows citizens to use digital signatures when entering into contracts, making it easier for businesses to conduct electronic commerce. The ESIGN Act does not, however, guarantee the security of digital records. It only provides a legal framework surrounding the use of electronic records and does not address the issue of encryption. For this reason, businesses should use encryption protocols to protect sensitive information from unauthorized access. Additionally, digital signatures and encryption software should be kept up to date in order to ensure the safety and security of electronic records.
