What are the laws concerning online gambling?
In North Carolina, online gambling is illegal and is considered a felony. The North Carolina General Statues prohibit online gambling, of which includes any form of online betting or wagering via the internet, telephone, or other device. Violation of these laws is punishable by up to four (4) years in prison and/or a fine of up to five thousand dollars ($5,000). The law defines “gambling” as risking something of value upon the outcome of a contest of chance or a future contingent event not under the actor’s control or influence, with the intent of winning a profit. This can include playing games of chance such as poker, blackjack, slots, and other online casino-style games. It is also illegal in North Carolina to operate an online gambling business. This includes profiting from the hosting or participating in these activities, either directly or indirectly. It is also illegal to advertise or promote online gambling products or services within the state. Any person or business found in violation of these laws may face criminal penalties including a fine of up to ten thousand dollars ($10,000) and/or imprisonment up to eight (8) years. Because of the illegality of online gambling in North Carolina, online casinos or other gambling sites are not allowed to operate within the state’s borders. Additionally, North Carolina residents are prohibited from participating in online gambling activities that occur outside of the state. If a North Carolina resident does choose to participate in online gambling activities, they may be subject to criminal prosecution, civil litigation, and/or fines.
