Yes, in Kansas, there are laws that address the issues of cyberstalking and cyberharassment. Under the Kansas statutes, cyberstalking is defined as the use of electronic communication to directly or indirectly threaten, harass, or intimidate a person. Cyberharassment is defined as the use of technology to repeatedly and maliciously harass or threaten another person. Under the Kansas cyberstalking and cyberharassment statutes, it is illegal to communicate using electronic devices to: cause another person fear of bodily injury or death; threaten to physically damage the property of another person; or to engage in identity theft or impersonation. These standards are designed to protect individuals from online abuse and harassment. The laws in Kansas also make it illegal to use technology to: monitor the physical movements or location of another person in a way that could cause fear or distress; intimidate, harass, or threaten another person with the objective of causing the other person to feel frightened, threatened, oppressed, persecuted, or intimidated; or to capture, store, or distribute images of another person without their consent. The penalties for cyberstalking and cyberharassment can range from a fine of up to $1,000 to up to a year in jail for a first time conviction. For a second or subsequent conviction, the court is authorized to impose more severe penalties, including community service, a longer jail sentence, and/or higher fines. Anyone who believes they have been the victim of cyberstalking or cyberharassment is encouraged to report the incident to their local law enforcement agency.
