What are the laws concerning the protection of trade secrets and confidential information?

In Kansas, the law concerning the protection of trade secrets and confidential information is regulated primarily by the Kansas Uniform Trade Secrets Act. This act provides protections for confidential business information that might include customer lists, formulas, pricing strategies, and other proprietary information. To qualify as a trade secret, the information must be not generally known or ascertainable by other persons, and it must have been the subject of efforts to maintain its secrecy. The Act prohibits the unauthorized disclosure or use of trade secrets. Any person who misappropriates a trade secret can be held liable for an injunction as well as damages. Additionally, the Act provides that employers may not, without consent of the employee, use any confidential information of the employee that was learned or acquired while working for the employer. The Kansas Uniform Trade Secrets Act also provides for protection against the misappropriation by former employers or third parties of trade secrets. Any individual, partnership, or corporation that has knowledge or possession of a trade secret has a duty to keep such information confidential. If a trade secret is misappropriated, the court may issue an injunction and/or award damages. In addition to the Kansas Uniform Trade Secrets Act, Kansas also has various other laws that serve to protect confidential information, such as computer fraud laws, state statutes which criminalize the unlawful procurement or destruction of records, and data breach notification laws that require businesses to notify customers in the event of a data breach.
