Are there any laws concerning the use of computer “bots” to generate automated trading on financial markets?
In California, computer "bots" are subject to several regulations and laws governing financial markets. The California Bureau of Electronic and Appliance Repair, Home Furnishings, and Thermal Insulation (BEARHFTI) is responsible for enforcing all laws related to these trading programs. One of the most important laws concerning "bots" is the Regulation Automated Trading (Reg AT). This law requires that trading bots be registered with the U.S. Commodity Futures Trading Commission (CFTC). This is to ensure that the bots do not make trades that violate CFTC rules and regulations. It also prevents market manipulation, insider trading, and fraud. Another law in California is the Trading Practices Act (TPA). This law states that all automated trading must comply with many standards set by the California Legislature and the State Securities Commissioner. The TPA also requires that bots must provide accurate information to customers when they are trading. On top of that, the TPA states that bots must meet certain disclosure requirements such as providing information on their trading systems, risk management procedures and potential losses. All in all, California has several laws governing the use of computer "bots" for automated trading on financial markets. The BEARHFTI is responsible for enforcing these laws and ensuring that bots follow all regulations. Furthermore, the Reg AT and TPA have specific requirements that bots must meet in order to engage in automated trading in California.
