The Mississippi Cyber Warfare and Computer-Based Attacks Prevention Act of 2020 was passed in 2020 to address these threats. The act requires the Department of Information Technology to develop and maintain a cyber security plan for the state, to include monitoring for and detection of cyber threats. It also requires the department to develop strategies and protocols for handling any security breach of state infrastructure and to provide training and education to state personnel related to cyber security. The law also prohibits the development, marketing or distribution of any computer-based, or cyber, attack software. It also makes it illegal for anyone to use, possess, access or otherwise control any computer-based attack software. This includes software that is designed for or used to gain unauthorized access to a computer system or to disrupt, damage or disable a computer system. Finally, the law provides for criminal penalties for any person who knowingly and intentionally violates the provisions of the act, including a fine of up to $5,000 and/or up to 5 years in prison.
