The act requires the Department of Information Technology to develop and maintain a cyber security plan for the state, to include monitoring for and detection of cyber threats. The law also prohibits the development, marketing or distribution of any computer-based, or cyber, attack software. It also makes it illegal for anyone to use, possess, access or otherwise control any computer-based attack software. Finally, the law provides for criminal penalties for any person who knowingly and intentionally violates the provisions of the act, including a fine of up to $5,000 and/or up to 5 years in prison.
