The legal process for construction accident cases in Washington requires the injured parties to show that the party responsible for the accident was negligent in some way. This means that the party responsible failed to act with the degree of care expected to ensure safety. To prove negligence, the injured party must prove that the responsible party failed to meet their obligations and that the accident was directly caused by their negligence. In Washington, the injured party can file a personal injury lawsuit against the person and/or company responsible for their injuries. In order to successfully pursue a personal injury claim, the injured party will need to gather evidence to support their claim and show how and why the responsible party was negligent. This evidence can include witness testimony, medical bills and records, and photographs of the accident site. The construction accident lawsuit must be filed within the statute of limitations, which is either three years in Washington or two years after the date of discovery of the injury, whichever is shorter. After the judge or jury makes their decision, the ruling is binding on both parties and cannot be appealed.
