Are workers’ compensation benefits taxable in a construction accident case?
In the state of Washington, workers’ compensation benefits are not typically taxable. This applies to construction accident cases as well. Workers’ compensation is a type of insurance policy that an employer purchases to protect their employees in the event of a work-related injury upon the job. It provides the injured worker with the benefits and compensation they need to recover from their injuries while they are unable to work. As such, it is not considered taxable income like a paycheck or other taxable wages would be. There are certain exceptions to this rule, however. If an injured worker receives more in benefits than they actually lost due to their injury, those additional benefits may be subject to taxation. For example, if an injured worker is entitled to disability benefits but also receives additional benefits for medical costs, those medical benefits may be taxable. In general, however, the majority of workers’ compensation funds received in a construction accident case should not be subject to taxation in the state of Washington. Furthermore, workers’ compensation benefits do not typically count as income and therefore will not impact an individual’s eligibility for other forms of assistance, such as welfare or Social Security.
