In New Jersey, legal requirements for notice of change orders in construction are outlined by the New Jersey Administrative Code Title 13, Chapter 2. According to the code, the party requesting a change order from the other party must provide written notice within 10 days of the change order being requested. The notice must include a written description of the changes, including the estimated increase in the contract price and any changes in the project completion date. The other party must then provide written acceptance of the change order within 14 days of receipt of the notice. If the notice is not accepted, and the parties cannot agree on the changes, the contractor may proceed with the work as requested or as negotiated. In addition, the code requires the contractor to provide notice of any change to the contract that includes a change in cost or in the completion date before the change is implemented. This notice must be provided to the owner within three days of the change. If the owner does not agree to the change, the contractor must provide the notice of the proposed change in writing to the owner and negotiate with the owner regarding the terms of the change. Once the parties agree on the change, it must be memorialized in writing and signed by both parties.
